For large portfolios processing thousands of applications, that looked like the future. Then the legal risk caught up. HUD’s 2024 guidance warned that the Fair Housing Act applies to tenant screening even when landlords use third-party companies, machine learning, or artificial intelligence. HUD’s later guidance rollback changed the agency’s active guidance landscape, but it did not erase the statute, private lawsuits, state laws, local voucher protections, the Fair Credit Reporting Act, or the basic duty to avoid discriminatory housing decisions. The result is a strange reset: landlords bought high-tech screening to avoid messy human judgment, but now they must prove that every high-tech decision rests on fair, relevant, and explainable basics.
